General Terms and Conditions
1. Subject of the contract
1.1. These General Conditions concern the purchase of products and services, made remotely, via telematic network, by Azienda Agricola Agrituristica di Atanasio Franco Miracco, C/da Arlino,17/A - 87048 Santa Sofia d'Epiro (CS) owner of the site www.agricolamiracco.it Every purchase operation will be governed by the provisions of Legislative Decree of September 6, 2005 n. 206 and, as regards the protection of privacy, will be subject to the regulations referred to in Law n. 196/2003.
1.2. The delivery times possibly indicated in the price list and/or confirmed by order confirmation may be subject to changes, also due to work scheduling. In any case, they are always indicative, never binding for the seller and are always understood as working days.
2. Acceptance of the general conditions of sale
2.1. The contract stipulated between Azienda Agricola Agrituristica di Atanasio Franco Miracco and the Customer is to be considered concluded with the acceptance of the order by the Miracco company. Such acceptance is considered tacit if the latter company begins to execute the contract. If the order is placed during holidays, the Miracco company reserves the right to accept the order within the first following working day.
2.2. The simple payment of the amount by the Customer, through online payment procedure or by credit card, does not constitute completion of the contract. Therefore, in the event that the Miracco company intends to refuse the purchase proposal made by the Customer, it will be required immediately, and in any case no later than the following twenty-four working hours, to return any amount paid in advance.
2.3. The Customer may not claim any compensation for damages or indemnity, nor assert any contractual or non-contractual liability, for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order.
2.4. By placing an order, the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept the general and payment conditions set out below.
3. Purchase methods
3.1. The Customer may only purchase the products present on the site at the time the order is placed as described in the relevant information sheets.
3.2. The image accompanying the descriptive sheet of a product may not perfectly represent its characteristics, but may differ for example, purely by way of example and not limited to, in color, size, accessories shown in the picture, etc. All information supporting the purchase is to be understood as simple generic informative material, not referring to the real characteristics of a single product.
3.3. The correct receipt of the order is confirmed by the Miracco company by means of a reply via e-mail, sent to the e-mail address provided by the Customer. This confirmation message will show an Order Number, to be used in any further communication with the Miracco company. The message repeats all the data entered by the Customer, who undertakes to verify its correctness and to promptly communicate any corrections, according to the procedures described in this document.
In case of non-acceptance of the order, the Miracco company will promptly notify the Customer.
3.4. The price list prices are valid until changes, which may occur at any time and without notice.
3.5. Payments will be made: by bank transfer or by Credit Card (PayPal circuit)
3.6. Transport and delivery costs are borne by the buyer.
