General terms and conditions
1. Subject of the contract
1.1. These General Conditions govern the purchase of products and services, carried out remotely, via telematic network, from Azienda Agricola Agrituristica di Atanasio Franco Miracco, C/da Arlino,17/A - 87048 Santa Sofia d'Epiro (CS) owner of the website www.agricolamiracco.it Each purchase transaction will be governed by the provisions of Legislative Decree of 6 September 2005 no. 206 and, as regards the protection of privacy, will be subject to the legislation set out in Law no. 196/2003.
1.2. Delivery times possibly indicated in the price list and/or confirmed by order confirmation may be subject to changes, also due to work scheduling. In any case, they are always indicative, never binding for the seller and are always understood as working days.
2. Acceptance of the general terms of sale
2.1. The contract entered into between Azienda Agricola Agrituristica di Atanasio Franco Miracco and the Customer shall be deemed concluded upon acceptance of the order by the Miracco company. Such acceptance shall be deemed tacit if the latter company begins to perform the contract. If the order is placed during holidays, the Miracco company reserves the right to accept the order itself by the first following working day.
2.2. The mere payment of the amount by the Customer, through an online payment procedure or by credit card, does not constitute completion of the contract. Therefore, if the Miracco company intends to refuse the purchase proposal submitted by the Customer, it will be required immediately, and in any case no later than the following twenty-four working hours, to refund any amount paid in advance.
2.3. The Customer may not claim any compensation for damages or indemnity, nor assert any contractual or non-contractual liability, for direct or indirect damage to persons and/or property, caused by the non-acceptance, even partial, of an order.
2.4. By placing an order, the Customer declares that they have read all the information provided to them during the purchase procedure and to fully accept the general and payment conditions set out below.
3. Purchase methods
3.1. The Customer may purchase only the products available on the website at the time the order is submitted, as described in the relevant information sheets.
3.2. The image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics, but may differ, e.g., purely by way of example and not limited to, in color, size, accessories shown in the picture, etc. All information supporting the purchase is to be understood as simple generic information material, not referable to the actual characteristics of a single product.
3.3. Correct receipt of the order is confirmed by the Miracco company by means of an e-mail reply, sent to the e-mail address provided by the Customer. This confirmation message will contain an Order Number, to be used in any further communication with the Miracco company. The message repeats all the data entered by the Customer, who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.
In the event of non-acceptance of the order, the Miracco company will promptly notify the Customer.
3.4. List prices are valid until changes, which may occur at any time and without notice.
3.5. Payments will be made: by bank transfer or by Credit Card (PayPal network)
3.6. Transport and delivery costs are borne by the buyer.
